ON THE CONDUCT OF ELECTRONIC PUBLIC PROCUREMENT By order of the National Agency of project management (reg. No. 3015 of 21.05.2018) regulated the activities of the operator of a special information portal on the organization of public procurement. We remind that the relations in the field of public procurement, conditions and requirements for their conduct are regulated by the Law of 9.04.2018 "on public procurement". The operator of a special information portal is a legal entity that provides the organization and conduct of procurement procedures, placement of advertisements, applications and other information on public procurement and their results on the portal. How to become an operator To do this, legal entities are sent to the National Agency of project management (hereinafter-NAPA): (1) application; 2) documents confirming their compliance with the established requirements, namely: : * availability of an electronic information system that provides information on public procurement and access to this information, guarantees of fulfillment of obligations through the clearing house, processing of statistics on public procurement; * availability of qualified personnel in the field of e-Commerce and information technology; * placement of the portal on the hardware and technical means located on the territory of the Republic; * the absence of bankruptcy procedures imposed on them. 3) draft rules of ethical conduct. They are taken by state customers and the operator to determine measures to prevent conflict of interest, as well as verification procedures and requirements for training. According to the results of the monthly examination of the submitted NAPA documents satisfies the application and gives the applicant the functions of the operator or refuses satisfaction of the statement. An agreement is concluded with the operator, which provides for the amount of the Commission fee in favor of the operator from the customers and participants. The amount of the Commission fee is the same for all operators. What is the responsibility of the operator The operator performs the following functions: * ensures the smooth functioning of the portal, the safety and integrity of the information placed on it; * provides free free access to the portal for customers and participants to participate in public procurement, as well as individuals and legal entities to the information contained on the portal; * organizes the exchange of information between public administration bodies in the portal; * provides technical support of the portal; • interacts with NAPA and such structures as GosKomInvest, "Winining»; * places on the portal a Single register of unscrupulous performers; * creates a register of contracts, etc. The portal also organizes the activities Of the Commission for consideration of complaints in the field of public procurement and is its working body. What is the procedure for admission to electronic procurement Access to electronic public procurement of customers and participants is carried out by the operator, subject to the presence of their EDS. Budget customers (state bodies, budget organizations, recipients of budget funds for procurement procedures, state funds) are allowed in a centralized manner in an automatic mode by electronic interaction of the Ministry of Finance and operator databases. Corporate customers are allowed by filling in the application form in electronic form on the portal. Participants must meet the following criteria for access: * the right to conclude a contract, i.e. the presence of EDS; * no tax arrears and other obligatory payments; * absence of bankruptcy procedures imposed on them; * no record of them in the Unified register of unscrupulous performers. Important! Admission of customers and participants is free and is carried out within one working day after entering the necessary data on the portal. The document also defines the procedure for concluding public procurement contracts and ensuring the execution of contractual obligations. The document was published in the National database of legislation and entered into force on 22.05.2018.
